Terms of Service

Welcome to DrapifyApp. These Terms of Service ("Terms") govern your use of the DrapifyApp web application, mobile application, and related services (together, the "Service") operated by DrapifyApp ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service you represent that you meet this requirement.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

3. The Service

DrapifyApp is an AI-powered fashion photography platform that generates synthetic images of models wearing garments you upload. Generated output is produced by third-party AI models and is probabilistic — results may vary, may contain visual artefacts, and should be reviewed before any commercial use.

4. Credits & Billing

  • The Service operates on a pre-paid credit model. Credits are consumed when you generate images; pricing per generation is displayed before you commit.
  • Credit purchases are processed by our payment partner (Razorpay) in Indian Rupees (INR). All prices are inclusive of applicable taxes unless stated otherwise.
  • Credits do not expire, are non-transferable between accounts, and have no cash value outside the Service.
  • All credit purchases are final and non-refundable. Full details, including automatic credit restoration for failed generations and the exceptions for duplicate or unauthorised charges, are in our Refund & Cancellation Policy.

5. Your Content & Licences

5.1 What you upload

You retain all ownership of garment photographs, fabric photographs, design mockups, and other material you upload ("Input"). You grant DrapifyApp a worldwide, royalty-free, non-exclusive licence to host, process, transmit, and temporarily cache your Input solely to operate and improve the Service.

5.2 What we generate

Subject to your payment and compliance with these Terms, you own the commercial rights to AI-generated images produced from your Input ("Output") and may use them for catalogue, e-commerce, advertising, and marketing purposes. You are solely responsible for ensuring your use of Output complies with applicable law, including intellectual-property and publicity rights.

5.3 What you must not upload

  • Content you do not own or have the right to use.
  • Images of identifiable individuals without their consent.
  • Content that is unlawful, defamatory, obscene, or infringes any third-party right.
  • Content depicting minors in any fashion-modelling context.

6. Acceptable Use

You may not, and may not permit others to: (a) reverse-engineer or attempt to extract the underlying AI models; (b) resell or redistribute the Service itself; (c) use the Service to generate deceptive, harmful, or illegal content; (d) probe or disrupt the Service's security or infrastructure; (e) use automated means to scrape the Service beyond the rate limits we publish.

7. Intellectual Property

All rights in and to the Service, including its software, design, trademarks, and documentation, remain the exclusive property of DrapifyApp and its licensors.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that Output will meet any specific commercial standard.

9. Limitation of Liability

To the maximum extent permitted by law, DrapifyApp's aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the 3 months preceding the claim. We will not be liable for indirect, incidental, consequential, or punitive damages.

10. Termination

We may suspend or terminate your account at any time if you materially breach these Terms or engage in fraudulent or abusive conduct, in which case any remaining credits are forfeit. You may stop using the Service at any time; there is no subscription to cancel and unused credits remain in your account, subject to our Refund & Cancellation Policy.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India. Courts in Gujarat, India have exclusive jurisdiction over any disputes arising out of these Terms, subject to any mandatory consumer-protection law in your country of residence.
